			<content:encoded><![CDATA[<p>During the Iraq War the Marines urgently ordered 180 of the Mk11 Mod 0 Sniper Weapon System's, but with the Army M110 Rifle Upper Receiver. This Mk11 / M110 hybrid was known as the Mk11 Mod 1. Later, the Marines began ordering the Mk11 Mod 2, a SOCOM / Navy developed variant of the SR-25 that is very similar to the M110.</p>

<p>Knight's Armament are now selling the last 50 of the Mk11 Mod 1 rifles that will ever be produced to civilians.</p>

<p>The suggested retail price ... <strong>$8508</strong>!  Most of these 50 rifles are already spoken for with only a few left for sale. It is more than I would spend on a rifle of this class, but I suppose it is also a piece of military history.</p>

<p>I actually had no idea the pistol found on Saddam was a Glock 18C. In my mind I always pictured him clutching an old Makarov. The Glock 18C is a fully automatic machine pistol and is probably the best choice of weapon for someone hiding in a spider hole, although the pistol was ironically unloaded at the time he was captured.</p>

<p><strong>Historical Context</strong></p>
<p>To understand the legal history of the AK-47 you need to understand the intellectual property history of the Soviet Union. Contra to popular belief the communists <a href="http://www.llrx.com/features/russiaiplaw.htm">did not oppose</a> intellectual property (IP). Our Soviet comrades were encouraged to think up inventions, they just has to give the invention to the state! After the 1917 Bolshevik Revolution private ownership in general was abolished but IP was overlooked. This oversight was corrected in 1931 when private ownership of IP was banned and the state automatically inherited all rights to inventions. The inventor received some small remuneration in return, presumably only if the invention was used by the state in some capacity.</p>

Fast forward about a decade and a young sergeant named <a href="http://en.wikipedia.org/wiki/Mikhail_Kalashnikov">Mikhail Kalashnikov</a> starts designing weapons for the Red Army. In 1946 his rifle wins a competition for the next standard issue rifle of the Soviet Union. During the following year the military began adopting the rifle and it was given the infamous designation AK-47, now a household name worldwide.</p>
<p>The Soviet Union was quite happy to allow other communist states to produce the rifle, with many other state and non-state entities around the world producing clones.</p>

<p>After the fall of communism the Russian Federation and eight other former Soviet Republics formed the <a href="http://www.eapo.org/index_eng.html">Eurasian Patent Organization</a> (EAPC). <a href="http://www.izhmash.ru/">Izhmash</a>, manufacturer of the AK-74 and AK-10x rifles (AK-47 successors), filed a patent with the EAPC. <p>The patent was filed over 50 years after the invention! The patent does not mention when the rifle was actually invented. Under United States law patents expire after 20 years. It seems ridiculous that a company can expect to patent an invention half a century after its invention especially at a time when it is so common that people build it <a href="http://www.thefirearmblog.com/blog/2007/09/03/amazing-video-showing-the-gun-market-in-durra-pakistan/">by hand in caves</a>!</p>

<p><strong>US Government purchases of AK-47 rifle</strong></p>
<p>Prior to the recent decision to switch the Iraqi Army over over to the M16 and M4, the US Government was purchasing a lot of AK-47 rifles to supply the fledging Iraqi Army. Russia was not happy about the US purchasing AK-47 clones from manufactures who were significantly under cutting Izhmash. From <a href="http://www.novinite.com/view_news.php?id=99099">Novinite.com</a>:</p>
<blockquote><p>The Americans have allowed Bulgaria to built a plant producing the Kalashnikov sub-machine gun to be sold in Iraq and Afghanistan, the Director for Special Assignments of the Russian Rosoboronexport State Corporation Nikolay Demedyuk stated on Wednesday cited by ITAR-TASS.</p>

<p>The Russians stated that the &#8220;Arsenal&#8221; production was undercutting the gun prices on international tenders citing as example a 2003 tender for the supply of 40,000 sub-machine guns for the Iraqi army for USD 65 each won by Arsenal and lost by the Russian &#8220;Kalashnikov&#8221; manufacturer.</p></blockquote>
<p>Russia has claimed it loses $2 billion per year from counterfeit production with only 10% of AK-47 rifles being produced under license.</p>

<p><strong>Last Month in Turkey</strong></p>
<p>There was a minor diplomatic incident last month at the IDEF &#8216;09 defense expo when the Russian delegation discovered that <a href="http://www.pof.gov.pk">Pakistan Ordnance Factories</a> had AK-47 clones on display. When confronted the Pakistan stated owned defense manufacture refused to remove the display.</p>
<p>Anatoly Aksenov, a senior advisor to the director general of <a href="http://www.roe.ru/">Rosoboronexport</a> (Russia&#8217;s sole export intermediary), said in a <a href="http://www.mosnews.com/military/2009/04/28/1364/">press release</a> &#8220;Russia will ask IDEF-2009’s administration to impose sanctions on Pakistan’s delegation if the counterfeit weapon is not removed from the booth by tomorrow &#8230; is piracy and we will struggle against it.&#8221;. The Turkish Ministry of Defense, who organized the expo, acted swiftly and the following day the rifles were <a href="http://lenta.ru/news/2009/04/30/pakistani/">removed</a> from display. </p>
<p>According to Mr. Aksenov Turkey is looking to purchase Russian short and medium range anti-aircraft systems, which no doubt gave the Russians much leverage with the Turkish Ministry officials.</p>
<p>The Russian media was quick to point out that the World Trade Organization worries itself with Western music, firms and clothing, but not Russian weaponry. <p><strong>Will this be resolved?</strong></p>
<p>Russia wants to join the World Trade Organization. Prior to joining the diplomats will have to define the parameters for recognition of patents. It is unlikely the WTO members will want to open themselves to lawsuits from Russian firms over 50+ year old inventions.</p>

<p>The Iraqi Army are slowing migrating from AK-47s to M16s and it looks like their Special Forces are getting M4 carbines for good measure. I am pleased to see they are getting the equipment they need.</p>

<p>The short (unextended length of 0.67 m) low cost and low weight (5.5 lbs) 66mm one-shot rocket system is useful in urban environments against buildings and lightly armored vehicles, such as those found in Iraq/Afghanistan. </p>

<p>Two government sources tell HUMAN EVENTS the sniper ammunition is sending alarm bells through the Pentagon as it hurries to keep pace by producing improved body armor for soldiers, Marines, airmen and sailors.</p>
<p>The sources said the Chinese munitions are not thought capable of defeating the super-hard ceramic plates that now protect service members against smalls-arms fire, including armor-piercing bullets.</p></blockquote>
<p>I know very little about AP ammunition. Does anyone know if M948 (7.62mm Saboted Light Armor Penetrator) or M993 (7.62mm AP) can penetrate Type IV ballistic vests and a ceramic plate insert?</p>

They replaced the stock with a McMillan M1A fiberglass one, developed a scope mount and added a Bausch &#38; Lomb 10&#215;40mm fixed-power optic or a Leupold Mark 4.</p></blockquote>

<p>Iraqi police Maj. Gen. Maj. Gen. Abdul al-Kareem Khaleef said he issued the firearms ban after a fatal shooting in Baqouba, the province’s capital, which killed one policeman and injured four civilians on Sunday.</p>
<p>&#8220;No civilians can have them or they will be detained,&#8221; warned Khaleef through a translator on Monday. He added that only Iraqi security forces and government security guards will be allowed to possess the weapons.</p></blockquote>

Some Iraqi units have been using M16s since May last year. The move was originally <a href="http://presszoom.com/story_130055.html">announced</a> last April.</p>
<blockquote><p>So far, the U.S. military has helped the Iraqi army purchase 43,000 rifles &#8211; a mix of full-stock M-16A2s and compact M-4 carbines. Another 50,000 rifles are currently on order, and the objective is to outfit the entire Iraqi army with 165,000 American rifles in a one-for-one replacement of the AK-47.</p>
<p>&#8220;Our goal is to give every Iraqi soldier an M-16A2 or an M-4,&#8221; Scott said. &#8220;And as the Iraqi army grows, we will adjust.&#8221; &#8211; Military.com</p></blockquote>
<p>Reasons given are logistical and that the M16 is a superior and more reliable weapon. Many think it is superior but few would say more reliable. It is easier to see the logistical benefits. I imagine training will also be easier.</p>
<p>The big advantage is that the rifles can be easily traced. Mexico has gone down this route by using a weapon they themselves designed. If a FX-05 &#8220;Xiuhcoatl&#8221; ends up in the hands of a drug runner, the Mexican army will know where to find the culprit who supplied it.</p>
<p>Last year it was reported that then an Iraqi soldier gets issued an M16 he is finger printed, undergoes a <strong>digital retina scan</strong>, and is photographed with the rifle serial number. The information is then transfered into a central database.</p>
<blockquote><p>The weapon exchange is just the first step in a five-day program of instruction for the Iraqis. However, new rifles are not handed out in a one-for-one swap. Coalition Forces assign each IA recruit a weapon using a high-tech, biometric issue system.</p>
<p>Verified against a master list and having tuned in his old rifle, the IA soldier and his new M-16 continue on to one of ten biometric stations, where he is finger printed, undergoes a digital retinal scan and is photographed with the M16&#8217;s serial number. <p><strong>My thoughts on the move to the M16<br />

The move of course also sends money to American factories. It makes sense as hundreds of millions have been spent on arms for the Iraqi army. At the end of last year Iraq&#8217;s defence Minister Abdul-Qadir al-Obaidi announced a US$230 million deal with Serbia for what is likely to be rifles, machine guns, explosives and ammo.</p>
<blockquote><p>Serbia has signed a US$230m (Â£116m) deal with Iraq to sell weapons and military equipment, the defence ministry said yesterday.</p>

<p>Unfortunately for the rest of us who do not own shares in ammunition manufacturers the supply of 5.56mm to yet another army at war, and who will be at war for a long time, means the price is only going to go up and up.</p>
<p>What does not make sense is why they do not supply them with the gas piston AR variants. Politics would be my guess. I think they had enough media attention over the body armor, they don&#8217;t want to be accused of issuing the Iraqi superior rifles.</p>

<p>The Australians already use a mixture of the AUGs with 1.5x sights and the &#8216;railed&#8217; AUGs. I have always thought that the 1.5x scope was a bad compromise on an assault rifle. The target acquisition speed is less than a non magnified red dot sight (I have no experience with magnified red dot sights) but lacks the benefits of a more powerful scope. It must be working for the New Zealanders because they are only thinking about converting 23% of their rifles.</p>

<p>The papers also suggest that, in 1977, six Iraqi soldiers were trained at Sandhurst, where Princes William and Harry subsequently underwent their military training.</p>
<p>&#8220;Steady sales&#8221; of &#8220;a wide range of smaller items&#8221; were also recorded including billiard tables.</p>
<p>Even more bizarrely, the regime purchased army shirts to the value of Â£830,000, meaning that the Iraqi army were wearing uniforms made in the UK.</p></blockquote>
<p>Of course, the UK government at the time was just like every other short sighted government supplying arms without thinking of the long term consequences.</p>

<p>A few seconds seems quite a long time, I suppose it depends on its range but in an urban environment it seems useless when mounted on vehicles or buildings. </p>
<p>The RPG-7 used in Iraq is typically used at 50-100m. Its extreme range is about 300m. After 4.5 seconds of flights it self detonates. I cannot see how this optical locater device will help vehicles in Iraq against RPG fire.</p>

<p>Blackwater had this to say:</p>
<blockquote><p>Allegations that Blackwater was in any way associated or complicit in unlawful arms activities are baseless. <strong>The company has no knowledge of any employee improperly exporting weapons</strong>&#8230; <strong>There is no indication that the weapons stolen&#8230; ever ended up in Iraq.<br />
</strong></p></blockquote>
<p><strong>My Opinion</strong>: Thousands of US weapons have ended up on the Turkish blackmarket. It is not unfeasible that some of these were bought by the PPK. It would not surprise me if these accusations are yet another attempt by the Iraqi government to increase pressure on Washington in order to force Blackwater out of Iraq.</p>
