Guns Or Medical Marijuana: You Can Only Choose One.

    Recently a letter was issued by the Hawaii Police Department stating that using medical marijuana disqualifies residents of their ability to own firearms and ammunition. Hawaii requires all legal firearms to be registered. Oh, and yes, we all know that the need to register your guns is stupid. Good, we got that out of the way.

    Now, something similar is happening in Pennsylvania. There are reports of medical marijuana users being denied firearms due to the PICS background check. Pennsylvania State Police have their own background check and it is required to be used over the FBI NICS check.

    The medical marijuana registry is used to deny people firearms. It comes down to question 11e on the 4473.

    Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?
    Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.
    How do you answer this question if you are a legal medical marijuana user? You can’t. Not without lying.
    So what can one do? Not much. If you want your guns you have to be cleared of medical marijuana from your doctor and be removed from the registry. Or stop buying guns in PA.
    Governor Tom Wolf is trying to overturn this issue but I don’t see how it will solve the problem of question 11e. You are still lying on the 4473. No matter what the state legalizes, it is illegal in the eyes of the Federal Government. So unless the Supreme Court steps in and does something, our hands are tied. The law is: smoke your joint or shoot your guns. You just can’t do both, legally.
